Terms of Service

The Czech version of this document is the legally binding one for users in the Czech Republic. This English version is provided for convenience.
1. Who we are and what these Terms cover
DrinksUp (the "service") is operated by Alethe, s.r.o., registered office Sládkova 1728/17, 360 01 Karlovy Vary, Czech Republic, Company ID (IČO): 09531025, registered with the Regional Court in Plzeň, section C, file no. 39786 ("we", "us"). These Terms govern your use of the service. By creating an account or using the service you accept these Terms.
2. Age requirement — 18+ only
The service involves alcohol consumption and is intended exclusively for persons aged 18 and over. By creating an account you confirm you are at least 18. We verify age via date of birth and close accounts of persons under 18.
3. Account
To use the service you must: be over 18; provide accurate registration information; keep your password confidential; and notify us of any unauthorised use. You are responsible for activity under your account.
4. The service
DrinksUp is a social pub-crawl game — you create routes between venues, invite friends with a code, complete tasks, vote, and compete on the leaderboard. We may add, change, or remove features.
5. Price and payment
Creating and starting a crawl is subject to a one-off fee paid only by the crawl's creator; all invited players then play at no further charge.

- Prices are final. Alethe, s.r.o. is not a VAT payer. The price you see before payment is the total amount you will pay — we charge no hidden or recurring fees, and this is not a subscription.
- Payment is processed by the payment service provider Stripe (Stripe Payments Europe, Ltd.) through a secure payment gateway. You enter your card details directly with Stripe; we have no access to your full card details.
- Payment is taken before the crawl starts. After successful payment the crawl is unlocked for the whole group.
6. Withdrawal from the contract
As a consumer you have the right to withdraw from a contract concluded at a distance within 14 days without giving a reason (Section 1829 of the Czech Civil Code).
However, creating a crawl is performance that we make available to you immediately at your express request. Before payment you therefore confirm that you:
- expressly request that performance (generating and making the crawl available) begin immediately, before the 14-day withdrawal period expires; and
- acknowledge that once the crawl is generated and made available you lose the right to withdraw from the contract (Section 1837 of the Czech Civil Code).
Until you generate and start the crawl, you may withdraw within the 14-day period by email to info@alethe.eu; in that case we will refund the amount you paid. You may also use the model withdrawal form, but this is not mandatory.
7. Complaints, defective performance and refunds
You have rights arising from defective performance under Section 2161 et seq. of the Czech Civil Code. Specifically:
- If we fail to deliver the service at all for technical reasons on our side (the crawl cannot be generated or made available), you are entitled to a full refund of the amount paid.
- If the crawl does open but a technical defect on our side makes it unplayable (e.g. an app bug preventing you from continuing the game), this is defective performance. In that case you have the right for us to primarily remedy the defect (repair, restoring the game). If the defect cannot be remedied within a reasonable time and without significant inconvenience to you, you are entitled to a proportionate discount on the price, or to a refund (withdrawal from the contract). We will agree the specific remedy with you according to the nature of the defect.
- Once the crawl is properly generated, made available and functional, performance has been delivered; in that case there is no defect and we do not refund the fee without another reason (see Section 6 on withdrawal). This does not affect your rights from defective performance above.
- To make a complaint, email info@alethe.eu — describe what happened (ideally with the date, time, and a screenshot). We will handle the complaint without undue delay, at the latest within 30 days.
- We refund money by the same method you used to pay, unless agreed otherwise.
8. Responsible consumption and your health
DrinksUp is an entertainment game. We do not encourage excessive alcohol consumption. Drink responsibly and within your limits. The app includes mandatory hydration tasks (drink water), but these do not replace your own judgement. Never drive under the influence of alcohol.
You acknowledge and confirm that:
- participation in the game and completion of every individual task are entirely voluntary; you may decline any alcohol-related task, duel, or punishment, or complete it in a non-alcoholic variant, without being disadvantaged in the game;
- whether, what, and how much you drink is solely your decision; no part of the game forces you to consume alcohol;
- you are responsible for your own safety and conduct while moving between venues;
- DrinksUp does not sell, serve, or supply alcohol — it is only a social game; venues on the route are independent businesses and we are not responsible for their services;
- points, rankings, and any rewards have no monetary or material value; the game is not gambling within the meaning of Act No. 186/2016 Coll. on gambling (it is not played for a prize of material value);
- you will respect venue rules, staff instructions, and public-order laws.
Liability for harm is governed by Section 13 of these Terms and by applicable law.
9. Your data
How we process personal data is described in the Privacy Policy.
10. Acceptable use
When using the service you must not breach the Acceptable Use Policy. We may suspend or terminate accounts that violate it.
11. Content and intellectual property
- We own the service, its code, and our brand.
- Content you upload (photos, crawl names, etc.) remains yours.
- By uploading content you grant us a limited licence to host, process, and display it to fellow players for the purpose of operating the service.
- By uploading content you confirm you have the right to share it and the consent of any identifiable people captured in it, and you agree to indemnify us against third-party claims arising from content you upload.
- We may use anonymized aggregate usage data to improve the service.
12. Service availability
We aim to keep the service available but provide no guarantee of uninterrupted operation. The service is provided "as is".
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential damages, lost profits, or lost data. To the extent we are liable for damage, our aggregate liability for claims of a monetary nature or related to the provision of the service is limited to the price you paid for the affected crawl.
These limitations do not apply to harm to the natural rights of a person (in particular to health), to harm caused intentionally or by gross negligence, or to consumer liability and rights that cannot be limited under mandatory law (in particular consumer law).
14. Termination
- You: delete your account anytime in settings.
- Us: with 30 days' notice, or immediately for material breach (abuse, illegal use).
On termination we delete your data per the Privacy Policy retention rules, unless a legal obligation requires longer retention.
15. Changes to these Terms
We may update these Terms. Material changes are notified by email at least 30 days in advance. Unilateral changes that materially worsen your position as a consumer entitle you to terminate without penalty before they take effect.
16. Governing law and consumer disputes
These Terms are governed by the law of the Czech Republic. As a consumer you may turn to the Czech Trade Inspection Authority (https://coi.gov.cz) as the body for out-of-court resolution of consumer disputes. We will also first try to resolve any dispute amicably; please contact us first at info@alethe.eu.
17. Public events and meetups
The service lets you create a public event — a pub crawl that people you don't personally know can join, to have fun and meet others.
- We are only a neutral platform. Public events are created and organised by users themselves. We do not screen, verify, recommend, or vouch for other participants, and we do not introduce anyone to anyone. We give no guarantee as to the identity, conduct, or trustworthiness of other participants.
- Participation is at your own risk. By joining a public event you acknowledge that you are meeting people you may not know. You are responsible for your own conduct, safety, and decisions when meeting up. We recommend meeting in public places, telling someone close to you where you are, and drinking responsibly.
- The event's host is responsible for their event and may remove any participant from it.
- 18+ only. Public events are intended solely for persons aged 18 and over.
- Reporting and moderation. Report inappropriate conduct, content, or an entire event using the "Report a problem" button in the app or at info@alethe.eu. You can block a user you don't want to meet. We reserve the right to hide or remove a public event and to suspend or terminate an account (in line with the Digital Services Act, Regulation (EU) 2022/2065).
- We are liable for harm arising in connection with users meeting only to the extent set out in Section 13 and under applicable law.
18. Public venue reviews
The app lets you rate venues you visit and add a comment. We may publish the ratings and comments you submit to other users, for example on the public venue map, but only in anonymized form — without your name, nickname, or any other identifier; only the comment text itself and the venue's aggregate rating are shown publicly. We tell you this in advance next to the comment field, and we only publish ratings submitted after that notice went live. By submitting a rating you acknowledge that its text may be shown to other users in this anonymous way; please do not include personal data in comments. Inappropriate comments can be reported with the "Report" button, and we reserve the right to hide or remove them. How we process this data is described in the Privacy Policy.
